FREEDOM OF INFORMATION - FEES FOR OBTAINING RECORDS

AMENDING RESOLUTION #12-08 & 14-12
 

BE IT RESOLVED, that Butman Township does hereby adopt the following fee schedule for establishing the proper charge for Freedom of Information requests under Public Act 442 of 1976. MCL 15.231. et seq. updated July 1 2015: In case of proof of indigence, the township board will waive up to $20 in fees for the information requested.

2. Computer Disks/Flash Drive

Cost of disk/flash drive 

3. Mailing

Actual Cost of Packaging and Mailing 

4. Labor

Lowest paid Butman Township employee capable of retrieving the information necessary to comply with a request under FOIA shall be charged and any other expenses of returning the FOIA requested files to their physical location prior to the FOIA viewing. All labor will be charged in 15 minute increments, with all partial time increments rounded down. 

5. On-Site Inspection

Labor Only 

Records may be viewed at the township offices during regular business hours. A member of the board may be present during this procedure. No records may be removed from the office. Inspection is limited to four (4) hours. Only a pencil (no pens), may be used if notes are taken Charges for this service will be based in 15 minutes Increments, with all partial time rounded down. 

6. Township Records Located Off-Site

There may be some cases when the records involved ( such as Assessor, Legal or Engineering) may be retained at another location. The charges for these records, if any, will be billed by the agency involved. 

SO THERE ARE NO MISUNDERSTANDINGS INVOLVED WITH REGARD TO THE ABOVE CHARGES…..PLEASE REQUEST AN ESTIMATE FROM THE TOWNSHIP REGARDING THE COSTS YOU MAY INCUR BEFORE FILLING OUT AN FOIA REQUEST FORM OR VISIT OUR WEBSITE FOR A FULL DISCLOSURE. 

Motion by Johnson, seconded by Ruppert to adopt the foregoing resolution. Upon roll call vote, the following voted Aye: 5 , the following voted Nay 0, the following were Absent 0.

The supervisor declared the motion carried and the resolution was adopted at a regular meeting of the township board held on June 11, 2015.
